These Terms of Service ("Terms") govern your use of Agency Builder Operating System ("ABOS"), a product of ABOS LLC, operated at agencybuilderos.com. By accessing or using ABOS you agree to be bound by these Terms.
ABOS is a SaaS platform designed for independent insurance agents and agency managers. It provides tools for client management, team management, AI-powered intelligence (GIDEON), SMS and email messaging, calling and dialing, production tracking, sales training, and related agency operations features. ABOS is offered in multiple subscription plans, including Solo Agent, Recruiter, and Empire Builder.
ABOS may offer a Founding Member rate to early subscribers of the Solo Agent plan for a limited time. ABOS may end the Founding Member offer at any time. Subscribers who enroll at the Founding Member rate keep that rate for as long as their subscription remains continuously active, and it will not be increased. If the subscription is cancelled or ends due to non-payment, the Founding rate is forfeited and any future subscription will be billed at then-current pricing. The Founding rate applies only to the Solo Agent plan.
Some ABOS features may be labeled as beta and may contain bugs, incomplete functionality, or change without notice. We appreciate your feedback.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You may not share your account with others or create accounts on behalf of others without authorization.
You agree to use ABOS only for lawful purposes related to your insurance agency business. You may not use ABOS to send unsolicited communications, infringe on third-party rights, or attempt to gain unauthorized access to any system or data.
You are solely responsible for complying with all laws governing your calls, text messages, and emails, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the CAN-SPAM Act, and applicable state telemarketing laws. This includes obtaining any required prior express consent before contacting a person, honoring opt-out requests, respecting Do Not Call registries, and observing permitted calling hours.
You agree to indemnify and hold harmless ABOS LLC from any claims, fines, penalties, or damages arising from your communications, your data, or your use of the platform.
You retain ownership of all data you enter into ABOS, including client information, notes, and records. By using the platform you grant ABOS a limited license to process your data solely to provide the service. You are responsible for ensuring you have the right to store and process any client data you enter into the platform.
You may request an export of your data at any time before your account is deleted.
If you connect your account to a manager's account, that manager will be able to see your aggregate production and training metrics, but not your individual client records or contact information. You may disconnect at any time.
ABOS uses third-party service providers, including for payment processing, messaging, calling, and AI features, to operate the platform, as described in our Privacy Policy.
The GIDEON AI feature is provided as a productivity tool. GIDEON's responses are generated by AI and may be inaccurate or incomplete. They should not be construed as legal, financial, insurance, or compliance advice. You are solely responsible for any decisions made based on GIDEON's output. ABOS makes no warranty regarding the accuracy or completeness of AI-generated content.
Free trial. New subscriptions may include a 14-day free trial. A valid payment card is required to start a trial. Unless you cancel before the trial ends, your card will be charged automatically at the end of the trial and monthly thereafter. We will send a reminder email before your trial ends.
Renewal. Subscriptions renew automatically each month and are charged to your payment method on file until cancelled.
Failed payments and cancellation. If a payment fails, we may retry the charge. If a payment cannot be collected, or when a cancelled subscription reaches the end of its billing period, access to ABOS will be suspended. Your data will be retained for 90 days, during which you may reactivate your account with all data intact or request an export. After 90 days, your data will be permanently deleted. You may request immediate deletion at any time by emailing support@agencybuilderos.com.
Cancellation. You may cancel at any time from your account billing settings or by emailing billing@agencybuilderos.com. Access continues through the end of the current billing period. No refunds are provided for partial months.
Price changes. We may change subscription prices with 30 days' notice by email. Founding Member rates are excluded from price changes as described in Section 2.
Connected agent pricing. Agents connected to a manager's account may receive a discounted rate. Eligibility is determined at each billing date: if you are connected to an active manager account on that date, the discounted rate applies; if not, the standard rate applies. We will notify you before your rate changes.
ABOS Phone numbers require a one-time, non-refundable setup fee of $20 per number. Monthly number fees and usage charges for calls and text messages are deducted from your prepaid ABOS Wallet balance at the rates shown in your account. Calls and messages will not be sent when your Wallet balance is insufficient.
Wallet balances are non-refundable except as required by law.
Phone numbers are provided by ABOS and may be released if your account is cancelled or your Wallet balance cannot cover monthly number fees. Transferring a number out of ABOS is not guaranteed.
We may suspend or terminate your account for violation of these Terms, non-payment, or any conduct we determine is harmful to the platform or other users. You may terminate your account at any time from your account billing settings, by contacting support@agencybuilderos.com, or by written notice to ABOS LLC.
ABOS is provided "as is" without warranty of any kind. To the maximum extent permitted by law, ABOS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including lost sales, lost commissions, or downtime. Our total liability to you shall not exceed the amount you paid for the service in the three months preceding the claim.
These Terms are governed by the laws of the State of Michigan. Any disputes between you and ABOS LLC shall be resolved in the courts of Muskegon County, Michigan.
We may update these Terms from time to time. We will notify you of material changes by email. Continued use of ABOS after changes take effect constitutes acceptance of the updated Terms.
